He met his wife, Dawnell Batista, in the 1980s, back when he was a medical resident and she was a young nurse.

But their marriage began to crumble as Dawnell’s health deteriorated due to kidney failure.
In 2001, when her condition reached the point where she needed a kidney transplant, Richard didn’t hesitate—he was a match, and he donated one of his own kidneys to save her.

His sacrifice worked like a miracle—Dawnell recovered, and their marriage briefly rekindled.

💔 The Unexpected Turn: Divorce and Betrayal

But four years later, in 2005, Dawnell filed for divorce.
Richard was devastated—and furious.

What followed was a four-year legal battle that pushed him to his breaking point.

Finally, Richard made a shocking demand:

The public was stunned.
Was he heartbroken… or just kidney-broken?

Richard insisted he had a good reason.
He claimed Dawnell cheated on him within two years of receiving his kidney—“cheating with my kidney,” as he put it.
To make things worse, he said she even kicked him out of their million-dollar home in Massapequa.

⚖️ Law vs. Emotion: What the Court Said

But in court, emotion means nothing.

Dawnell’s legal team argued that an organ is not something you can sell or demand back, and the judge agreed.

In 2009, the court ruled that:

  • Human organs are not property, according to New York State law
  • You cannot assign monetary value to a donated organ
  • Asking for payment could even lead to criminal charges
  • Removing the kidney would endanger Dawnell’s life

In other words:
The kidney stays with Dawnell—forever.

After four exhausting years, Richard was left with:

  • No wife
  • No kidney
  • No money

📚 A Case That Became a Bioethics Landmark

Yet he didn’t walk away entirely empty-handed.
His situation became a famous example in bioethics and is still cited in legal cases today.
