A Bite That Turned Into a Nightmare
On September 11, 2018, Brandy drove to the drive-through window of Bruster’s Ice Cream, just as she had done many times before. She ordered her usual butter pecan ice cream and took a big bite without hesitation. 
Her young son asked for a taste, and she pulled over under a streetlight to feed him. Before she could hand him a spoonful, something unusual caught her eye.
Hidden deep inside the ice cream was a metal nail. It was almost completely buried, making it nearly impossible to notice at first glance.
A sudden wave of fear hit her. She had already taken a large bite.
She later recalled feeling something stuck in her throat. At the time, she assumed it was a pecan. After all, she had ordered butter pecan ice cream. But now, the situation felt far more serious.
A Shocking Medical Discovery
Concerned about what she might have swallowed, Brandy went to the hospital for an X-ray.
Her fears were confirmed. Doctors discovered that she had indeed swallowed a nail, which was lodged in her throat. Even worse, they found that she had also ingested multiple small metal fragments.

The case turned into a long legal battle that lasted for years. Both sides fought intensely, and the truth remained contested for a long time.
Finally, on March 24, a jury reached a verdict. They ruled that the ice cream company was responsible for the incident.
Initially, Brandy and her husband had only sought $15,000 in damages, which was the minimum threshold for the court handling the case. However, after considering the severity of her injuries and the lifelong consequences, the jury awarded them $14 million.
A Bittersweet Outcome
While the compensation amount was significant, legal experts noted that such figures are not unusual in the United States. Cases involving permanent injury, especially those affecting fertility, often result in high payouts.
